Unfair competition law

The competition law establishes rules for a fair business life: Entrepreneurs and consumers shall be protected against “black sheeps” in the business world. Examples:

  • E-mail spam, fax or other annoying advertisements
  • Misleading advertisements
  • Incorrect legal notices on websites
  • Infringements of consumer protection, of the law on advertising in the healthcare system or the right of withdrawal.

In the case of unfair behaviour competitors or associations for consumer protection can send a warning (cease and desist letter) to avoid a repetition of such unfair behaviour. If the warning is not successful the next step can be an action for an injunction.
